1. INTRODUCTION
Welcome to PakkaLokal.biz ("Platform"), operated by Palo Infotech Private Limited ("Company", "We", "Us", "Our"). These Terms and Conditions ("Terms") govern your access to and use of the Platform, including browsing, purchasing, selling, and all related services.
By accessing or using the Platform, you ("User", "You") agree to be bound by these Terms, our Privacy Policy, and all applicable laws.
2. PLATFORM SERVICES
PakkaLokal.biz operates as an online marketplace connecting Suppliers/Sellers with Resellers/Retailers and End Customers for wholesale and retail purchase of products.
Key Services:
Product catalog browsing and search
Wholesale pricing for resellers (minimum order quantities apply)
Order placement, payment processing, and order tracking
Nationwide delivery through partnered logistics
Reseller support, order management dashboard
Customer support via WhatsApp/phone/email
3. USER ELIGIBILITY
Minimum Age: 18 years or legal age in your jurisdiction
Registration: Valid phone number, email, and complete address required
Business Users: GSTIN required for resellers claiming input tax credit
Account Responsibility: You are responsible for maintaining confidentiality of login credentials
4. SELLER/SUPPLIER TERMS
4.1 Listing Requirements
Valid GST registration
Product images (min 3 high-quality images)
Accurate product descriptions, specifications
Wholesale pricing (inclusive of taxes)
Minimum Order Quantity (MOQ) specification
7-day return/replacement policy compliance
4.2 Commission Structure
Platform commission: 10% per order for plan PL Basic and 0% for PL Advanced
Payment settlement: T+2 days (2 days after delivery confirmation)
Payment settlement: T+2 days (2 days after delivery confirmation)
4.3 Seller Obligations
Maintain minimum 95% order fulfillment rate
Ship within 24 hours of order confirmation
Ensure 100% order quality compliance
Respond to customer queries within 2 hours
5. BUYER/RESSELLER TERMS
5.1 Order Placement
All prices displayed inclusive of GST
Platform Fee applicable on all orders
5.2 Payment Terms
Secure payment via payemnet gateway/PayU/UPI
Secure payment via Razorpay/PayU/UPI
Order confirmation via WhatsApp/SMS/Email
Payment gateway charge: 2% (added to order total)
5.3 Delivery Timeline
Metro Cities: 2-3 working days
Tier 2/3 Cities: 3-5 working days
Remote Areas: 5-7 working days
Shipping Partner: Delhivery/BlueDart/Ecom Express
6. RETURNS, REFUNDS & REPLACEMENT
6.1 Buyer Returns (7-Day Policy)
Defective/Damaged: 100% refund/replacement
Wrong Product: 100% refund/replacement
Size/Color Issues: Exchange only (same price)
"Change of Mind": No returns after delivery
6.2 Return Process
Raise return request within 7 days via app/website
Upload clear photos of issue/damage
Reverse pickup scheduled within 48 hours
Refund processed within 3-5 working days

7. PAYMENT & SETTLEMENT

7.2 Seller Payouts
Timeline: T+2 (2 days post-delivery confirmation)
Deduction: Platform commission + shipping + returns
Method: Direct Bank Transfer (NEFT/RTGS/IMPS)
Minimum Payout: ₹1000
8. PROHIBITED ACTIVITIES
Strictly Prohibited:

❌ Products violating IPR (copyright/trademark)
❌ Hazardous/illegal substances
❌ Adult content/pornographyol>
❌ Weapons/ammunition
❌ Animals/live plants/
❌ Medical drugs without prescription
❌ Lottery/gambling services
9. INTELLECTUAL PROPERTY
7.1 Buyer Payments
All Platform content (logo, design, code) owned by Palo Infotech Private Limited
Product images/listings property of respective sellers
Sellers grant Platform non-exclusive, royalty-free license to display listings
Unauthorized copying/scraping strictly prohibited
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
Platform not liable for product quality/authenticity
No liability for seller/buyer disputes
Maximum liability capped at order value
No consequential/indirect damages
11. TERMINATION
We may suspend/terminate accounts for:
Fraudulent activity/transaction
Repeated policy violations
Non-compliance with KYC requirements
Legal/regulatory violations
12. GOVERNING LAW & DISPUTE RESOLUTION
Governing Law: Laws of India
Jurisdiction: Courts of Alappuzha, Kerala
Dispute Resolution: Arbitration under Arbitration & Conciliation Act, 1996
13. FORCE MAJEURE
Not liable for delays/failures due to:
Natural disasters, war, terrorism
Government actions/regulationsa
Internet/telecom failures
Courier/logistics partner delays
14. AMENDMENTS
